INTRODUCTION

These terms of use govern your purchase from and your use of www.frederikbagger.eu / www.frederikbagger.dk websites, and form a contract between you and Frederik Bagger ApS (36059567)., Grønnegade 36, 1107 Copenhagen K, Danmark (from now on referred to as “FB”). By making a purchase from and using this website, you have accepted these terms of use. Please make sure to have read and understood these user terms when using our website. If you accept these terms, click the “I accept” checkbox under the payment information in the payment process. Please understand that if you do not accept these Terms & Conditions, you will not be able to order products from our website.  

1. Confirmation:
Your order constitutes an offer to us to buy and pay for a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email, confirming the product’s shipment (“shipping confirmation”). The contract between us (“contract”) will first be established when we send you the shipping confirmation. We recommend saving this email to facilitate any contact with customer service you may have in the future. The order confirmation (receipt) also serves as a guarantee of proof of purchase. The contract will only relate to the products that have been confirmed in the shipping confirmation. We are not required to deliver other products that may have been part of your order until the shipment of those products has been confirmed in a separate shipping confirmation. We have the right to deny any order you place at your sole discretion.

2. Payment:
You may pay with either payment or credit card or Applepay. FB does not save credit card numbers.
Payment with card: Securely pay with Mastercard or AMEX.
Your card information is immediately sent to the bank and cannot be read or accessed by anyone other than your bank. There are no additional fees for card payments unless the customer’s bank charges a fee to the customer. When paying with a credit or debit card, the starting conditions apply as soon as the card transaction is approved. In the event that no payment has been received after the submission of your order, FB can automatically cancel your order

3. Discount codes:
Discount codes must be entered in checkout to be valid. Attempts to apply a discount code after purchase will not be approved.

4. Taxes:
All prices displayed on FB’s website, www.frederikbagger.eu / www.frederikbagger.dk, include VAT in accordance with the applicable law. Note, that in instances where an order is sent to a delivery address outside of the EU, you may be charged import duties and taxes, which are charged once the shipment reaches your delivery address. You are responsible for paying such import duties and taxes. It should be noted that FB does not have control over these charges and since these fees vary from country to country, FB cannot predict their amount. FB advises you to contact your local customs office for further information.

5. Order & Returns:
Consumers have the right to return the order within 30 days after receiving it. The right only applies if the product and its original packaging can be returned in the same condition as when received.
If the consumer exercises their right to return an order. Frederik Bagger does not cover return freight or any additional customs expenses to Denmark.
If you wish to return your order, you must pay for the return shipping through the parcel shop you use.
You only have to return damaged or defective products if requested by customer service.
Remember to keep your receipt for returning the products. Frederik Bagger does not have the ability to track your return shipment when we are not the sender.

The amount will be automatically refunded to the payment card on which the order was originally placed. We are unable to transfer the amount to other payment cards.

If an item is defective or damaged in any way on arrival, FB must be contacted within 30 days for information about compensation. FB has the right to refuse any returns exceeding its date.
Orders completed in another person's name without the person’s consent will be reported to authorities.

6. Warranty:

Glass Plague Warranty:
If your glasses have been exposed to glass plague, we offer a 10-year glass plague warranty. The same guarentee is provided if the product is purchased from one of our retailers. If that is the case, please contact the retailer directly.

To apply for compensation covered by this warranty, you must turn contact us by email: info-eu@frederikbagger.com:
Please specify your order number, and write a detailed description of the problem and attach pictures of each glass.
This warranty guarantees free replacement(s) if in accordance with the terms and within the specified period. Matters other than the above-mentioned Glass plague are not covered by this warranty.

Porcelain:
Frederik Bagger offers a 2-year breakage warranty on porcelain on normal use. Please keep your receipt so you can document your warranty.

Glass:
Frederik Bagger does not offer a breakage warranty on glass products. Normal wear and tear and accidents do not fall under the right to file a complaint. 
We cover manufacturing defects and products damaged due to shipping.This warranty covers manufacturing defects on the product, as well as a clarity warranty against potential discoloration or cloudiness of glass.

7. Privacy Policy:
We treat all your personal information as confidential and will only use it in accordance with our Privacy Policy (see section 2). In addition, we process information about you in accordance with our Privacy Policy (see section 2). By using our website, you consent to such processing and you affirm that all data you provide is correct. When you shop on this website, we ask you to provide personal information so that we can identify you. For instance, your name, email address, billing address, delivery address, credit card, or other payment information. We confirm that this information will be held by us in accordance with applicable laws and regulations.

8. Product:
FB has the right to adjust prices, involve additional costs, and change product information such as product images and offers without notice. If a price is incorrect, it may force FB to cancel the purchase and refund the amount paid in the best manner. This can be done at any time. The available product images and information texts reflect the product as much as possible. We reserve the right to any potential errors that may occur on the website, and cannot guarantee that all images accurately reflect the true appearance of the product. Images may vary depending on the color setting on your computer. All images are for illustration purposes only and do not guarantee correct appearance and product properties.

9. Delivery & Cancellations:
Our delivery time is 4 - 8 working days unless other is stated.
Note: during stressful periods, for instance, Black Friday, weekends, and bigger holidays - there may be delays and longer delivery times.

Please note that if you wish to return your order, Frederik Bagger does not cover return freight and customs costs to Denmark.

Your order will be dispatched with GLS Home and the package will be delivered to your home address.

We will send you an email as soon as the order has been shipped. Deliveries are made in cooperation with parcel services and their partners. You have the right to cancel your purchase and return the delivered items by contacting FB customer service or using our contact form on FB’s website within 30 days of receiving the order, provided that the items have been unpacked and are in the same condition as when you received them. However, the customer is responsible for the risk of transportation when returning items to FB. In the event that you as a customer believe the delivery is so delayed that you no longer wish to fulfill the order, it is your responsibility to cancel it. In cases where the order has already been dispatched, the customer is to receive the order. Cancellation is not valid until the customer has confirmed with FB through one of our contact methods. If a product has been discontinued, FB has the right to cancel the purchase and refund the amount paid to the customer. FB is to notify the customer of potential replacement or exchange of the equivalent product if available. 

10. Complaints:
It is important that you as a customer carefully examine your products once you have received your package to ensure the products have not been damaged and match your order.
Complaints are submitted to our customer service through one of the contact methods on our contact page within 30 days of receiving it. 
Please follow the guideline for Claims on our website and we will get back to you as soon as possible (usually within 24-48 hours).

If the product was purchased from one of our retailers, you must contact that retailer directly.

You only have to return damaged or defective products if requested by customer service.
Defective products returned to FB should be treated as if they were defect-free. In all types of returns, it is extremely important that the products are packed safely with no risk of getting damaged under transportation. FB has the right to replace defective products with products of the same model. If the product has been discontinued, the customer will be fully reimbursed.

You have a 2-year right of complaint from the date of purchase.

11. Liability: FB’s liability regarding errors in connection with delivery is limited to existing sales conditions. FB bears no direct or indirect liability for, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work, or other financial damage. To you, we can guarantee that any product purchased from us through our website, is of satisfactory quality and reasonably fit for all purposes for which products of that nature are normally supplied, and will remain so for a period of 24 months from the date of delivery. Our liability for any loss you suffer as a result of breaching this agreement, is strictly limited to the purchase price of the item you purchased. In no way, does this exclude or limit our liability for; death or personal injury caused by our negligence; fraud or misleading guidance; or in any case for which it would be unlawful for us to exclude or attempt to exclude our liability. We are not responsible for indirect losses that occur as a side effect of the main loss or damage, including but not limited to:

Loss of income or revenue

Loss of business;

Loss of profit or contracts;

Loss of expected savings;

Loss or corruption of data; or

Waste of management and working hours

However arising or caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

You acknowledge that we cannot guarantee and are not responsible for the security or confidentiality of the website, and any information provided by you. You bear the risk associated with using the internet.

13. Force Majeure:
FB is exempted from liability of damages and other sanctions for the performance of the contract prevented, hindered, or delayed by circumstances beyond our control. Release factors include government intervention, new/changed legislation, lack of government, war, fire, floods, labor disruption, bans, restrictions, sabotage, poor transportation or weather conditions, lack of supply from suppliers, and if the company is exposed to criminal activities that may affect fulfillment of its own activities.

14. Website usage and intellectual property rights:
